Philly murder suspect may face death penalty

Marlon Mullings, the man who allegedly gunned down McConigley in 1999, appeared at a preliminary hearing in a Philadelphia court Tuesday. He was held on bail until his formal arraignment on Oct. 22, the anniversary of McConigley’s death.
Mullings faces a list of charges including murder, weapons possession, aggravated assault and burglary.
“At least at this preliminary stage we are looking at a death penalty case,” prosecutor Jude Conroy said.
Mullings, who was extradited from his native Jamaica earlier this year, is one of four men facing charges in connection with the death of McConigley, a Fannad native who was gunned down as he chased a gang who had robbed his business partner, Sean Clinton.
Though 15 months passed before the first arrests were made, the investigation never lapsed, even when it became the responsibility of the Philadelphia homicide division’s cold case squad.
A car license plate turned out to be a critical clue that ultimately led to the arrest of three men, twins Marlon and Alan Pitter, and Cerrone Furman, the first of the three to be detained. He was arrested in January 2001. All three men were charged with multiple counts, including murder.
But the fourth man, Mullings, who investigators early on believed to be the actual shooter, continued to elude police up until his apprehension in Jamaica.
